The CCPA defines “personal information” as “information that identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or household.” This includes, but is not limited to:
- Names and aliases
- Post address
- Unique personal identifiers
- Online identifiers
- Internet Protocol (IP) address
- Email address
- Account name
- Social security number
- Driver’s license or passport number
- Commercial information, including records of personal property
- Biometric information
- Browsing, search, or other internet or electronic network activity information
- Geolocation data
- Audio, electronic, visual, thermal, olfactory, or similar information
- Professional or employment-related information
- Education information
- Inferences drawn from any of these information types in this subdivision to create a consumer profile
Personal information under the CCPA does not include publicly available information, which is “information that is lawfully made available from federal, state, or local government records”. It does not mean biometric information collected by a business about a consumer without a consumer’s knowledge. It also does not include consumer information that is de-identified or aggregate consumer information.
